PARTIES AND SCOPE
These are the terms and conditions (“Terms”) that govern the relationship between you, our customer (referred to as “you”, “client” in these terms) and AnyVisa Ltd (“AnyVisa”, “we”) for provision of service by AnyVisa. If you are not a Consumer, you confirm that you have the authority to bind any business on whose behalf you seek to purchase services.
AnyVisa provides its service as a third party connecting you and the issuing authority (referred to as “consulate” in these terms).
We deem an order received by us when we receive your order and/or its related documents and/or when you submit your order on our website.
By instructing AnyVisa to act as your agent for the provision of passports, visas and other related services, you agree to all the terms set out below. AnyVisa reserves the right to change these terms without explanation at any time. All such changes will come into effect once they have been published on www.anyvisa.co.uk.
INFORMATION WE PROVIDE - VISA FEES AND PROCESSING TIMES AND CHANGES TO THEM
AnyVisa will do every effort to provide you with the most accurate and reliable information and to process applications as requested by you. However, this information is outside the control of AnyVisa and subject to change by the consulate without prior notice. The information includes, but is not limited to visa types and eligibility, consulate fees, required documentation, application forms, and processing times. AnyVisa shall not be held liable should it becomes impossible to proceed with an order as a result of the changes to this information.
FOLLOWING ON GUIDANCE AND ADVICE WE PROVIDE
AnyVisa provides information required to process an order based on consulate requirements and guidance, our experience and knowledge. We expect the clients to follow this guidance and shall not be held liable should the client not be following the guidance or any of its parts.
DECISION ON VISA APPLICATIONS
The decision on your order is the sole discretion of the consulate and is beyond AnyVisa’s control. We therefore cannot be held liable for such a decision should it not be what the client requested. This includes, but is not limited to one’s eligibility for a visa, visa validity, type, number of entries, etc.
OUR HANDLING FEES AND CHANGES TO THEM
AnyVisa fees are set out on our website and/or communicated to the client separately verbally or in writing via email. We reserve the right to change our handling fees based on the nature and complexity of your order and/or market level without prior notice. Such a change may be order specific or service specific. Thus, handling fee on certain orders may be different to the ones on our website.
Should our handling fee change orders already placed with AnyVisa will be charged at the rates applicable at the time of the receipt of the order by AnyVisa. Should AnyVisa deem possible to process an order based on the handling fees announced to the client when answering their initial inquiry on their order.
INVOICING AND PAYMENT TERMS
Invoices are given to each client upon receipt of their order. Outstanding balance must be settled in full before AnyVisa is due to release your documents/visas/deliver ordered service. AnyVisa will not be able to release visas/documents to the client until the balance is settled in full.
In some instances, we agree a credit period for some clients, which cannot be longer than 30 calendar days from the date of the invoice.
Payment terms and methods are indicated on each invoice and/or invoice emails.
CANCELLATION OF A SERVICE
In case of cancellation of the services ordered by the customer, AnyVisa will refund prepayments made by the customer (1) in full if AnyVisa has not started processing the customer’s order or incurred costs (such as consulate fees and/or invitation fees) related to the services being cancelled; or (2) less up to £65+VAT cancellation fee (depending on the complexity of the work done) in addition to any costs AnyVisa incurred in relation to the order.
Applications cannot be cancelled and travel dates cannot be changed after applications have been submitted to the consulate and the service charge and visa fee will apply in full.
Withdrawal procedure of already submitted documents to a consulate will be the subject to that consulate’s relevant policy and is beyond AnyVisa’s control.
LIMITATION OF LIABILITY
By submitting your order to AnyVisa for processing you accept all the requirements, restrictions and limitations on liability set forth herein and specifically agree and confirm that AnyVisa shall not be liable to you for any failure to comply with the necessary visa requirements for your travel, for the action or inaction of any government body and/or for the performance by any third party such as delivery companies.
Should AnyVisa fail to complete your order as a result of its wrongdoing and not due to factors beyond its control, in no event shall AnyVisa be liable to you for any indirect, special, consequential or incidental losses or damages, including, without limitation, lost profits, or for exemplary damages. Your sole and exclusive remedy against AnyVisa for damages in connection with the failure to process your order in a timely manner shall be the return of the AnyVisa handling fee actually paid by you or £250, whichever is less.
AnyVisa recommends not purchasing tickets or making any financial commitments prior to the issuance of a visa, except where it is a specific requirement of the consulate.
DOCUMENTS HANDLING AND SAFEKEEPING
AnyVisa will always endeavour to ensure safekeeping of clients’ documents. However, AnyVisa does not accept responsibility for loss/damage of any documents whenever they are not in our possession, which includes but is not limited to documents submitted to a consulate or in transit with a third party courier/delivery service, etc. Often, we are not given a proof of submission by the third party showing list of submitted documents and/or the name of the owner of the documents as this is not a standard policy at many consulate and delivery companies.
Moreover, we do not accept liability for loss/damage to the documents resulting from acts of God, weather conditions, public enemies, war, strikes, acts or omissions by public authorities.
For the avoidance of doubt, we consider damage as a physical change to a document that renders the document invalid. Cosmetic damages such as fold marks generally do not render documents invalid are, therefore, not considered as damage. Furthermore, some authorities require us to staple our company tags to original documents submitted to them and/or fold the documents around passports upon submission. Fold marks and cosmetic changes to documents may occur and be unavoidable.
ISSUED VISAS AND PASSPORTS
AnyVisa will always endeavour to process applications per clients' request. However, it is the responsibility of the client to check the validity of the passport, visa or document issued to ensure that it covers the period of stay requested, the number or entries required and is also valid for trip. AnyVisa does not bear any responsibility for mistakes and misprints made by a consulate however we are always ready to provide help and support in difficult situations should the client notify us about any mistakes or misprints in visa upon collecting the passport.
CLAIMS PERIOD
Any claims for compensation of direct cost arising as a result of AnyVisas’s wrongdoing must be filed within 60 calendar days from the date of our invoice.
COMPLAINTS PROCEDURE
Should the client not be happy with the service provided by AnyVisa they can send their complaint by emailing to complaints@anyvisa.co.uk stating the order number, client name and nature of the complaint.
All complaints are reviewed by AnyVisa management. We will reply to the complaint within 30 days of receipt of the email where we will explain our position, any actions we have taken as a result of the complaint and if our decision has any effect on the client.
CAPTURING, PROCESSING AND USING PERSONAL INFORMATION
AnyVisa collects, processes, and stores clients’ personal information as required by consulates. The information is never shared or bartered with third parties unless this is required to process your order. This includes sharing personal information with a consulate as required by them, delivery service to enable delivery of your documents. This is in addition to the Privacy Policy of this website.
